The Indictment alleges that PIERRE sent patients to MARVIN MOY and WEINER for electrodiagnostic testing, which PIERRE directed. PIERRE also directed them to perform unnecessary and painful physical examinations, and PIERRE paid them for these services. As a result of the testing, PIERRE received payments from insurance companies for the clinical diagnoses that he directed and made to the patients.

The defendants have been charged with conspiracy to commit health care fraud and mail fraud. Their cases have been assigned to U.S. District Judge Richard M. Berman in the Southern District of New York. They are each facing a maximum term of 20 years in prison and maximum $1,000,000 fine. No plea has been entered and the charges contained in the Indictment are merely accusations and the defendants are presumed innocent unless and until proven guilty.

This case is being prosecuted by the Office’s Complex Frauds and Cybercrime Unit. Assistant U.S. Attorneys William F. Sweeney, Jr. and James C. Flanigan and Trial Attorney Greg D. Andres of the Criminal Division’s Fraud Section are in charge of the prosecution. The U.S. Department of Health and Human Services, Office of Inspector General, the New York State Attorney General, and the U.S. Postal Inspection Service are assisting with the investigation.

The case is being handled by the Office’s Complex White Collar Crimes Unit. Assistant U.S. Attorneys J. Christopher Kohn and Irvin B. Nathan are in charge of the prosecution. The case was investigated by the Internal Revenue Service-Criminal Investigation. The case is being investigated by the National Health Care Anti-Fraud Center. The case has been assigned to U.S. District Judge Liam O’Grady.
